

Qualcuno nel settore moda ha tirato un sospiro di sollievo quando la direttiva Green Claims si è fermata. Ha fatto male i conti, perché le regole che contano sono già legge.
Dal 27 settembre si applicano in Italia le nuove norme sulle asserzioni ambientali, già inserite nel Codice del Consumo. Nessuno vi chiederà un certificato prima di pubblicare un claim. Ma alcune formulazioni sono vietate e basta, e l’Autorità Garante della Concorrenza e del Mercato (AGCM) non deve nemmeno dimostrare che il consumatore sia stato ingannato.
Se fate moda, conviene rileggere tutto: cartellini, schede prodotto, pagina sostenibilità, post social.
La Direttiva (UE) 2024/825 è stata recepita con il D.Lgs. 30/2026, che modifica gli articoli 18, 21, 22 e 23 del Codice del Consumo. Il punto decisivo è l’art. 23, cioè la lista delle pratiche ingannevoli in ogni caso. Da questo mese ci entrano cinque cose.
Cambiano anche le promesse sul futuro. “Net zero al 2050” è ingannevole se non c’è dietro un piano dettagliato, con traguardi misurabili e verificato periodicamente da un terzo indipendente (art. 21).

Onere della prova
L’Autorità può chiedervi le prove, e se mancano o sono insufficienti i vostri dati si considerano inesatti (art. 27, commi 5 e 9). L’onere della prova è vostro.
Le regole colpiscono chi parla al consumatore: marchi, e-commerce, pubblicità. Una conceria, una tintoria o un terzista B2B non ne è destinatario diretto, ma ne paga gli effetti. Il brand che scrive “pelle a basso impatto” o “cotone riciclato” deve dimostrarlo, e i dati li deve chiedere a voi.
La nostra previsione
Nei prossimi mesi le richieste di documentazione lungo la filiera aumenteranno e saranno molto più precise di quelle arrivate finora. Chi ha già i numeri pronti sarà il fornitore più comodo da tenere.
Il settimo è quello che tutti rimandano. È anche l’unico che l’Autorità vi chiederà.

Sanzionate Giorgio Armani S.p.A. e G.A. Operations S.p.A. Le dichiarazioni etiche non erano coerenti con le condizioni di lavoro presso fornitori e subfornitori di pelletteria.
Nel caso Shein l’Autorità ha ricordato che chi opera in un settore molto inquinante ha un dovere di diligenza maggiore. Il messaggio è chiaro: l’Autorità guarda anche i claim sociali, e guarda lungo tutta la filiera, fino ai terzisti.
La proposta del 2023 prevedeva una verifica di terza parte prima di ogni claim. A giugno 2025 la Commissione ha annunciato di volerla ritirare, e a settembre 2026 la procedura è ancora ferma. Aspettarla per organizzarsi è una scommessa persa in partenza.
